NOVA Signals

1. Acceptance of Terms

By downloading or using the NOVA Signals app (the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App. The App is owned and operated by Bashar Alasfoor (NOVA / novatradeq8), Kuwait.

2. Eligibility

You must be 18 years of age or older and have full legal capacity to use the App. By using it, you confirm you meet this requirement.

3. Nature of the Service — Not Financial Advice

• The App provides signals, analytics, and educational content based on price patterns and market data for informational and educational purposes only.
• Neither we nor the App are financial advisors, brokers, portfolio managers, or licensed to provide investment services. No advisory or fiduciary relationship is created.
• No signal, analysis, or content constitutes a recommendation, offer, or solicitation to buy or sell any financial asset.
• You must conduct your own research and consult a licensed financial advisor before making any trading decision.

4. No Guarantee of Results & Past Performance

• We do not guarantee any profit or outcome. Past performance does not guarantee future results.
• Any backtesting results or win-rate statistics are hypothetical, have inherent limitations, and may differ from actual trading due to slippage, liquidity, fees, and market conditions.
• Data may be delayed, inaccurate, or unavailable for reasons beyond our control.

5. User Responsibility

You bear sole and full responsibility for all your trading and investment decisions and any resulting profit or loss. Any reliance on the App's content is entirely at your own risk.

6. Disclaimer of Warranties

The App and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, uninterrupted operation, or error-free content.

7. Limitation of Liability

To the maximum extent permitted by law, neither we nor our owners, staff, or providers shall be liable for any direct, indirect, incidental, consequential, or punitive losses or damages, including trading losses, lost profits, or loss of capital, arising from your use of, or inability to use, the App or your reliance on its content. In all cases, our total aggregate liability shall not exceed the amount you actually paid for your subscription in the three months preceding the event.

8. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, losses, liabilities, or expenses (including legal fees) arising from your use of the App, your breach of these Terms, or your violation of any law or third-party rights.

9. Subscriptions & Payments

Subscriptions and payments are handled through the Apple App Store and subject to its terms. Subscriptions auto-renew unless cancelled before the period ends via your Apple account settings. We do not control payments or refunds managed by Apple.

10. Intellectual Property

All rights to the App, its content, marks ("NOVA Signals"), and algorithms are owned by us. They may not be copied, distributed, resold, or reverse-engineered without written permission.

11. Prohibited Use

You agree not to misuse the App, attempt to hack it, commercially redistribute its signals, or use it for any unlawful purpose.

12. Termination

We may suspend or terminate your access to the App at any time and without notice if you breach these Terms or to protect the service and its users.

13. Changes to Terms

We may update these Terms from time to time and will post the updated version here. Continued use after an update means you accept the new version.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Kuwait, and the courts of Kuwait shall have exclusive jurisdiction over any dispute arising from or relating to them, without prejudice to any mandatory rights granted by the law of the user's country of residence.

15. Severability

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
